Eine Bildmarke ist eine spezielle Art der Marke, die aus grafischen Elementen besteht und dazu dient, Waren oder Dienstleistungen eines Unternehmens von denen anderer Unternehmen zu unterscheiden.
Besteht ausschließlich aus Bildern, Symbolen, Logos oder grafischen Gestaltungen, ohne Buchstaben oder Zahlen.
Beispiel: Das Apple-Logo (Apfel mit Biss).
✔️ Kombination mit Wortbestandteilen möglich
Falls eine Marke sowohl ein Bild als auch ein Wort enthält (z. B. ein Logo mit Schriftzug), spricht man von einer Wort-Bild-Marke.
Beispiel: Das Nike-Logo mit dem Schriftzug „Nike“.
✔️ Schutzumfang
Eine eingetragene Bildmarke schützt die konkrete grafische Darstellung.
Nachahmungen mit ähnlichem Design können verboten werden.
✔️ Schutzdauer & Verlängerung
Einmal registriert, gilt der Schutz für 10 Jahre und kann unbegrenzt um jeweils 10 Jahre verlängert werden.
✔️ Anmeldung und Schutzgebiete
Eine Bildmarke kann national (z. B. beim Deutschen Patent- und Markenamt, DPMA), europaweit (als Unionsmarke beim EUIPO) oder international (über die WIPO) geschützt werden.
