Der Verlustausgleich bezeichnet die Möglichkeit, Verluste mit positiven Einkünften zu verrechnen, um die steuerliche Belastung zu reduzieren. Dabei gibt es zwei Arten des Verlustausgleichs:
Hierbei werden Verluste mit positiven Einkünften im gleichen Steuerjahr verrechnet. Dabei gelten folgende Regeln:
Innerhalb einer Einkunftsart (z. B. Gewinne und Verluste aus Gewerbebetrieb) ist der Ausgleich grundsätzlich uneingeschränkt möglich.
Zwischen verschiedenen Einkunftsarten (z. B. Verluste aus Gewerbebetrieb mit positiven Einkünften aus Vermietung) ist ein Ausgleich ebenfalls möglich, es gibt jedoch Einschränkungen, etwa bei Verlusten aus Kapitalanlagen oder steuerlich begrenzten Verlusten aus Beteiligungen.
2. Interperiodischer Verlustausgleich (zwischen verschiedenen Jahren)
Falls der Verlust innerhalb des Jahres nicht vollständig verrechnet werden kann, gibt es zwei Möglichkeiten:
Verlustrücktrag: Der Verlust wird mit dem Gewinn des Vorjahres verrechnet, wodurch es zu einer Steuererstattung kommen kann.
Verlustvortrag: Falls kein Verlustrücktrag möglich oder sinnvoll ist, kann der Verlust in die Zukunft übertragen und mit zukünftigen Gewinnen verrechnet werden.
Besondere Einschränkungen
Verluste aus bestimmten Einkünften, wie privaten Veräußerungsgeschäften oder bestimmten Beteiligungen, können oft nur mit gleichartigen Gewinnen verrechnet werden.
Verluste aus Kapitalvermögen können nur mit Einkünften aus Kapitalvermögen verrechnet werden (keine Verrechnung mit anderen Einkunftsarten).
Der Verlustausgleich ist eine wichtige steuerliche Möglichkeit, um finanzielle Belastungen zu reduzieren und die Steuerlast zu optimieren.
